Seashell Killa — Website Terms of Service

These Terms of Service (“Terms”) govern your access to and use of seashellkilla.com (the “Site”), including browsing, searching, creating an account, and purchasing products (collectively, the “Services”). By using the Services, you agree to these Terms.

1) Eligibility & Your Account

  • You must be 13+ to browse; 18+ to purchase.

  • Keep your account credentials confidential. You’re responsible for all activity under your account.

  • We may refuse service, close accounts, or cancel orders at our discretion (e.g., suspected fraud, policy abuse).

2) Permitted Use

  • You may access the Site for personal, non-commercial use only.

  • No scraping, crawling, data mining, bulk downloading of images, reverse engineering, or using bots/automations without our written consent.

  • Don’t interfere with the Site’s security or operation (e.g., DDoS, injecting code, circumventing paywalls or controls).

3) Product Info, Pricing & Availability

  • We try to display colors, sizing, and details accurately but actual colors may vary by device.

  • Prices, styles, and stock change without notice. We may correct mistakes (including pricing errors) and cancel orders not yet shipped.

  • Placing an item in your cart does not reserve it.

4) Orders, Payment & Shipping

  • We accept the payment methods shown at checkout; by submitting an order you authorize the charge.

  • Risk of loss passes to you upon carrier pickup. Delivery dates are estimates.

  • Taxes and shipping fees are shown at checkout and are non-refundable unless required by law.

5) Returns & Exchanges (Summary)

  • For hygiene and small-batch realities, no returns or exchanges on worn/washed/altered items or items with hygiene liner removed/tampered.

  • Eligible returns are store credit or exchange only within the stated window.

6) User Content (Reviews, Photos, Messages)

  • If you submit reviews, photos, or other content (“User Content”), you represent you own or control the rights and it doesn’t infringe others’ rights, is lawful, and not misleading or harmful.

  • You grant Seashell Killa a nonexclusive, royalty-free, worldwide license to use, reproduce, display, and distribute your User Content in connection with the Site, social channels, ads, and emails.

  • We may moderate or remove User Content at our discretion.

7) Intellectual Property

  • All Site content (designs, text, images, logos, product photos, videos) is owned by Seashell Killa or its licensors and is protected by IP laws.

  • Except for your limited right to access and shop, no license is granted. Don’t reproduce, sell, or commercially exploit Site content without written permission.

8) Promotions, Gift Cards & Store Credit

  • Promotions/coupons are subject to their own rules and may change or end without notice.

  • Gift cards and store credits are not redeemable for cash (unless required by law) and are subject to expiration terms stated at issuance.

9) Privacy & Cookies

  • Your use of the Services is subject to our Privacy Policy, which explains what we collect and why, including cookies and similar technologies.

  • By using the Services, you consent to electronic communications from us (e.g., order confirmations, service notices). Marketing emails/SMS require separate opt-in and can be opted out at any time.

10) Third-Party Links & Tools

  • The Site may link to third-party sites or use third-party tools (e.g., payment providers). We’re not responsible for their content, policies, or actions. Use them at your own risk and review their terms.

11) Prohibited Activities

  • Illegal or harmful conduct, harassment, hate speech, or the posting/sharing of others’ private information.

  • Attempting to bypass inventory limits, run resale operations, or exploit promotions.

  • Uploading malware or engaging in security testing without permission.

12) Disclaimer of Warranties

  • AS IS / AS AVAILABLE. To the fullest extent allowed by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement).

  • We do not warrant uninterrupted or error-free operation, or that defects will be corrected.

13) Limitation of Liability

  • To the maximum extent permitted by law, Seashell Killa and its owner(s) will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill.

  • Our total liability for any claim relating to the Services or products will not exceed the amount you paid to us for the product(s) at issue in the 12 months before the claim arose.

14) Indemnification

  • You agree to defend, indemnify, and hold harmless Seashell Killa and its owner(s) from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your User Content, or your breach of these Terms.
